1. Agreement to Terms

By accessing or using the DailyLens website and game (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, stop using the Service immediately.

These Terms form a legally binding agreement between you ("User") and DailyLens ("we," "us," or "our").

2. Description of the Service

DailyLens is a daily web-based game where users are shown two images side-by-side — one real photograph and one AI-generated image — and must identify which is which. A new puzzle is released each day.

3. Eligibility

You must be at least 13 years of age (or 16 in the EEA) to use this Service. By using DailyLens, you represent that you meet this requirement.

4. User Accounts

4.1 Guest Play

You may play without an account. Guest progress is stored locally on your device; we have no control over or responsibility for it.

4.2 Google OAuth Accounts

By signing in with Google, you agree to maintain the security of your credentials and accept responsibility for all activity under your account.

4.3 Account Termination by Us

We reserve the right to suspend or permanently terminate your account, without notice or liability, if we determine you have:

• Attempted to hack, scrape, or reverse-engineer any part of the Service or its backend infrastructure.
• Attempted to manipulate or circumvent the daily puzzle reset logic, timezone handling, or scoring system.
• Used automated bots, scripts, or crawlers to access or interact with the Service.
• Violated any provision of these Terms.
• Engaged in conduct harmful to users, us, or third parties.

5. Intellectual Property

5.1 Real Photographs (Pexels)

The "real" photographs displayed in DailyLens puzzles are sourced from Pexels and remain the exclusive property of their respective photographers and rights holders. These images are used in accordance with the Pexels License. DailyLens does not claim any ownership over these photographs.

5.2 AI-Generated Images (Gemini API)

The AI-generated images in daily puzzles are produced on-demand using the Google Gemini API and are provided solely for the purpose of enabling gameplay within the Service. The Gemini API terms and Google's usage policies govern these outputs.

5.3 Restrictions on All Game Images

Regardless of whether an image is a photograph or AI-generated, you may not:

• Scrape, download, copy, or harvest images from the Service in bulk or through automated means.
• Redistribute, republish, or sublicense any image from the Service on any platform.
• Use any image from the Service for commercial purposes, including advertising, merchandise, or resale.
• Attempt to reverse-engineer, identify, or extract metadata from any image for purposes outside normal gameplay.

Violations may result in account termination and may expose you to legal liability.

5.4 DailyLens Brand

The DailyLens name, logo, website design, game concept, source code, and all original content we create are our exclusive intellectual property. You may not use our branding or proprietary content without our prior written consent.

6. Acceptable Use

You agree not to: Use the Service for any unlawful purpose; interfere with or disrupt the integrity or performance of the Service or its servers; attempt to gain unauthorized access to any part of the Service; transmit viruses, malware, or other harmful code; harass, abuse, or harm any person; or impersonate any person or entity.

7. Disclaimer of Warranties

We expressly disclaim all warranties, including:

• Availability. We do not guarantee uptime. The Service may go down for maintenance, technical issues, or third-party outages at any time.
• AI-generated content. Image generation is probabilistic. We make no representations about the content, accuracy, or appropriateness of AI-generated images; unexpected or imperfect outputs may occur.
• Data accuracy. Game scores, streaks, and progress may be lost due to technical failures or database errors beyond our control.
• Fitness for a purpose. DailyLens is for entertainment only.

8. Limitation of Liability

This includes, without limitation: downtime or outages; unexpected AI-generated content; data loss; or issues arising from third-party services (Google, Vercel, Supabase, Pexels). In all cases, our total aggregate liability shall not exceed USD $10.00.

9. Third-Party Services

DailyLens integrates with Google, Vercel, Supabase, Pexels, and the Gemini API. These services have their own terms and privacy policies. We are not responsible for the practices, content, or reliability of any third-party service.

10. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

We may update these Terms at any time by posting a revised version here. Your continued use constitutes acceptance of the updated Terms.

11. Governing Law & Disputes

These Terms are governed by the laws of -, without regard to conflict of law principles. Disputes shall be subject to the exclusive jurisdiction of the courts in -.

12. Indemnification

You agree to indemnify and hold harmless DailyLens and its affiliates, officers, and agents from any claims, liabilities, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Severability & Entire Agreement

If any provision of these Terms is found invalid or unenforceable, it shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and DailyLens with respect to the Service.
